The jurists differed as to whether the divorce of a menstruating woman counts as such or not. The majority are of the view that it does count as such, but there is a group of scholars who say that it does not, and this is the view reflected in the Fatwas of many contemporary jurists such as Shaykh Ibn Baz.

Divorcing a pregnant wife is in accordance with the Sunnah. There is a widespread notion among the common people that divorce during pregnancy is contrary to the Sunnah, but there is no basis or evidence for this view.

If the wife is divorced before her husband had intercourse with her, she does not have to observe any ‘Iddah at all. If the husband had intercourse with her, she has to observe ‘Iddah in different forms.
